You agree to defend, indemnify, and hold harmless Stormcloud, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
- Your violation of these Terms and Conditions
- Your use or misuse of our services
- Your violation of any third-party rights, including intellectual property rights or privacy rights
- Any content or information you submit, post, or transmit through our services
- Your breach of any representation or warranty contained herein
- Any damage caused to a third party by your actions or inactions

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Exclusion of Consequential Damages
Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages. In such jurisdictions, our liability will be limited to the greatest extent permitted by law.

- Epidemic, pandemic, or public health emergency
- Labor disputes, strikes, or lockouts
- Failure of telecommunications or internet infrastructure
- Cyberattacks, hacking incidents, or malicious software
- Fire, explosion, or other catastrophic events
Upon occurrence of a force majeure event, we will make reasonable efforts to minimize the impact and resume normal operations as soon as practicable.
Governing Law and Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of Norway, without regard to its conflict of law provisions. Your use of our services may also be subject to other local, state, national, or international laws.
Dispute Resolution

- Class Action Waiver: You agree to bring claims against us only in your individual capacity and not as part of any class or representative action
Severability and Waiver

If any provision of these Terms and Conditions is found to be unlawful, void, or unenforceable, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of the remaining provisions. The invalid or unenforceable provision shall be replaced with a valid, enforceable provision that most closely matches the intent of the original provision.
Waiver
No waiver by Stormcloud of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any failure to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
Entire Agreement
These Terms and Conditions, together with our Privacy Policy and any other legal notices or agreements published by us on our website, constitute the entire agreement between you and Stormcloud regarding the use of our services.
These Terms supersede and replace any prior agreements, understandings, or representations, whether oral or written, regarding the subject matter herein.
Modifications to Terms
